Royal Training Club, LLC. Liability Waiver / Informed Consent Form Please read this Waiver and Release of Liability Agreement carefully before you sign it. This is a legal document which affects your legal rights.
I,______________________________________________________ in consideration for being allowed to engage in fitness activities and other activities (the "Activities") at the Royal Training Club studio or related location (the "Company”), do hereby acknowledge, understand and agree as follows:
1. I am aware that the activities involve known and unknown risks, dangers, and hazards which can result in serious physical or emotional injury, paralysis, death or damages to myself, property or other persons and that personal injuries and damages are a common and ordinary occurrence when engaged in the Activities. I understand that among other things, there is a strong risk of: a. the failure of equipment belonging to myself, the Company or others; b. broken bones, sprains, head, neck and back injuries, abrasions and bruises and other similar injuries; and c. the negligence, failure to act reasonably and failure to exercise due care by Royal Training Club, LLC, its employees, staff, and agents, myself, or others. I UNDERSTAND THAT THERE IS ABSOLUTELY NO GUARANTEE OF MY SAFETY. I acknowledge that I have been advised to consult with my physician before participating in any of the Activities and accept all responsibility for any failure to do so. I understand that I may not be covered under any insurance held by Royal Training Club, LLC, any parent, subsidiary or affiliate thereof, as well as any director, officer, shareholder, employee, volunteer, representative, agent or contractor of any of the foregoing, and any party or entity under the direction or control of any of the foregoing.
2. I hereby RELEASE AND FULLY DISCHARGE Royal Training Club, LLC, any of their directors, officers, stockholders, agents, employees, staff or independent contractors and their respective sureties, insurers, successors, assigns and legal representatives (collectively, the "Representatives") from any and all liabilities, claims, actions, damages, costs or expenses of any kind or nature, including reasonable attorneys' and paralegals' fees (whether incurred in anticipation of or at trial or in appellate or bankruptcy proceedings) which I may have against them arising out of or in any way connected to my participation in the Activities, use of equipment at the Royal Training Club studio or related location, or presence at the Royal Training Club studio or related location unless resulting from willful or wanton recklessness or an intentional tort of Royal Training Club, LLC, or any of their Representatives. I understand that THIS RELEASE INCLUDES A RELEASE OF ANY CLAIMS BASED ON THE NEGLIGENT ACTION OR INACTION of myself, of any of the Company or their Representatives, any person present at the Royal Training Club studio or related location, or any equipment present at the Royal Training Club studio or related location.
3. I accept for myself full responsibility for any and all injuries or damages of any kind which may result from my participation in the Activities, use of equipment at the Royal Training Club studio or location, or presence at the Royal Training Club studio or location and it is my intention to INDEMNIFY AND HOLD HARMLESS the Company, any of their Representatives, from all liabilities, claims, actions, damages, costs or expenses or any kind or nature whatsoever, including reasonable attorneys' and paralegals' fees (whether incurred in anticipation of or at trial, or in appellate or bankruptcy proceedings) which I or any other person may have against them arising from or as a result of my presence at the Royal Training Club studio or related location, my use of equipment at the Royal Training Club studio or related location or my participation in the Activities, unless resulting from willful or wanton recklessness or an intentional tort of the Company or any of their Representatives.
4. I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT BY SIGNING THIS RELEASE, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING, WITHOUT LIMITATION, THE RIGHT TO SUE THE COMPANY OR THEIR REPRESENTATIVES.
5. I am signing this Agreement freely and of my own accord, realizing it is binding upon myself, my heirs, executors, assigns and other legal representatives.
6. I agree that this Agreement is intended to be construed and interpreted as broadly and inclusively as permitted by the laws of California. Every term and provision of this Agreement is intended to be severable. If any one or more of the terms and provisions of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that shall not affect the other terms and provisions of this Agreement, which shall remain in full force and effect.
7. I warrant that I am over eighteen (18) years of age, have read and fully understand this Agreement and that no oral representations, statements or inducements have been made. This Agreement represents that entire Agreement among myself and the Company with respect to the matters contained herein.
8. I agree to abide by all rules and regulations that the Company may impose regarding the use of the Company’s studio, use of equipment and participation in the Activities.
9. I agree and understand that this is a continuing release that applies not only to my present participation in the Activities, use of equipment at the Company studio or related location and presence at the Company’s studio or related location, but shall also apply to my future participation in any of the Activities, use of equipment and presence at the Company’s studio or related location.
10. I agree that should I or my successors assert any claim in contravention of this Agreement, the asserting party shall be liable for the expenses (including legal fees) incurred by the other party or parties in defending, unless the other parties are finally adjudged liable on such claim by a court of competent jurisdiction.

11. I acknowledge and agree to the following terms regarding the presence of my pet (specifically dogs) on the premises of Royal Training Club, LLC: Personal Responsibility: I am fully responsible for my pet at all times while on the premises. This includes ensuring the safety and behavior of my pet and preventing any disruption or harm to other members, staff, or property. Liability: I understand that Royal Training Club, LLC, and its staff are not liable for any injury, damage, or loss caused by or to my pet. I agree to hold harmless and indemnify Royal Training Club, LLC, from any claims, damages, or expenses arising from the presence of my pet on the premises. Compliance with Laws: I agree to comply with all applicable laws and regulations regarding pet ownership and behavior. This includes ensuring my pet is properly vaccinated and well-behaved. Removal of Pets: I understand that Royal Training Club, LLC, reserves the right to request the removal of any pet from the premises at its discretion if the pet is deemed disruptive, aggressive, or otherwise problematic.
12. This Agreement shall not be modified orally, and a waiver of any provision shall not be construed as a modification of any other provision herein or as a consent to any other provision herein or as a consent to any subsequent waiver or modification.
